Rep. Scott “Putin’s Just Alright With Me” Perry (R-PA via a tinfoil hat factory), a major target in the Justice Department’s Special Counsel investigation into the January 6th insurrection, has just suffered another setback in his attempts at staying free, thanks to a judge ruling against his lawsuit to keep relevant documents on his phone private.
Chief Judge Beryl A. Howell of the U.S. District Court in D.C. instead released a number of previously sealed opinions after finding that the “powerful public interest” outweighed the need for secrecy in the constitutional battle over Perry’s claims and the historic investigation.
Perry — who still supports Donald Trump’s Big Lie that the 2020 presidential election was “stolen” from him — claims that the more than 2,200 documents on his phone were “protected by the Speech or Debate clause in the Constitution,” which safeguards members of Congress from criminal investigations into their actions.

Judge Howell wrote in her ruling against Perry that “What is plain is that the Clause does not shield Rep. Perry’s random musings with private individuals touting an expertise in cybersecurity or political discussions with attorneys from a presidential campaign, or with state legislators concerning hearings before them about possible local election fraud or actions they could take to challenge election results in Pennsylvania.”

DOJ Special Counsel Jack Smith’s investigation has also obtained nearly 40 emails between Perry and Trump lawyer John Eastman, who’s in plenty of federal hot water himself for pushing 2020 election fraud claims.

Smith is also in possession of well over 300 documents regarding Perry’s communications with former DOJ official Jeffrey Clark, whom Trump wanted to install as Attorney General amid their attempts to get the Justice Department to reverse its finding that Joe Biden had been elected fairly.
