DEEP DOODY: Federal judge rejects Rudy Guiliani's attempt to slither out of lawsuit

Disgraced Trump attorney Rudy Giuliani can’t stop losing. Giuliani’s latest ‘L’ is coming from the federal judge who rejected the former New York City mayor’s request to dismiss a lawsuit from election workers he falsely accused of committing voter fraud.

Former Georgia election workers Ruby Freeman and Shaye Moss filed a lawsuit against Giuliani and others for defamation, intentional infliction of emotional distress, and civil conspiracy in December of last year. It was amended in May 2022 naming the longtime Trump ally as the sole defendant.

U.S. District Court Chief Judge Beryl Howell, the judge presiding over the case, wrote:

“Defendant Rudolph Giuliani—a current media personality and former politician once dubbed ‘America’s mayor’ —propagated and pushed that false narrative. Caught in the crossfire of Giuliani’s campaign to undermine the legitimacy of the 2020 election were plaintiffs Ruby Freeman and Wandrea ArShaye (‘Shaye’) Moss (collectively, ‘plaintiffs’). Freeman was a temporary election worker with the Fulton County Registration and Elections Department in Fulton County, Georgia during the 2020 general election, while Moss worked on Fulton County’s absentee ballot operation.”

In a 27-page opinion, Judge Howell ruled that the case brought by Freeman and Moss was enough to justify advancing their lawsuit against Giuliani and presented “ample circumstantial evidence of a civil conspiracy between Giuliani and members of the Trump Campaign.”

In December of 2020, the former attorney implemented a plan called the “Giuliani Presidential Legal Defense Team,” with a section devoted to election “fraud” in Georgia. Freeman was named in the Plan as being “under arrest” and part of “coordinated effort to commit voter/election fraud.”

“Giuliani specifically accused Freeman and the other workers in the Edited Video of ‘ballot stuffing’ by rolling out ‘suitcases’ filled with ballots when ‘press and all third parties were required to leave the premises’ — an event the Strategic Plan calls ‘Suitcase Gate.’ Id. On December 23, 2020, Giuliani, on his podcast, named Freeman as someone with ‘a history of fraud participation,’ and claimed that she, with the help of other election workers, counted the same ballots ‘eight times,’ ‘cheating’ in manner that ‘look[ed] like a bank heist.’ On December 25, 2020, Giuliani, again on his podcast, accused ‘Ms. Freeman and her crew’ of attempting to scan ballots multiple times, likening them to ‘crooks spr[i]ng[ing] into action.’”

“I mean, it’s obvious to anyone who’s a criminal investigator or prosecutor that they are engaged in surreptitious, illegal activity,” Giuliani said. “And they’re still walking around Georgia. They should have been questioned already. Their homes should have been searched for evidence,” Giuliani stated.

Emotional televised testimony in June by the mother-daughter pair showed the real-life impact the baseless accusations had – and continues to have – on their lives. Detailing unrelenting harassment and death threats, not even Moss’s grandmother was safe.

“The threats and harassment that ensued even reached Moss’s grandmother, who called one day, screaming, to say people had knocked on her door and, when she had opened it, had tried to push into the home in search of Moss and Freeman,” court filings state.

Prior to January 6th, Freeman – affectionately called “Lady Ruby” – was forced to flee her longtime home after federal officials informed the election worker that her name was found on a “hit list.”

Rudy Giuliani is neck-deep in civil and criminal legal investigations because of his involvement in Trump’s scheme to deny then-President-elect Joe Biden his rightful place as commander-in-chief.

Fulton County District Attorney Fani Willis is moving full steam ahead in her probe, and — thanks to Judge Howell’s recent decision — Giuliani may finally be held accountable.

Hopefully, this will bring Moss and Freeman one step closer to closure.

A previous lawsuit brought against right-wing media outlet One America News for defamation was settled earlier this year.
