After the news broke this morning that Roger Stone may have broken the gag order that Judge Amy Berman Jackson had imposed on him after posting her photo to Instagram with the crosshairs of a rifle next to her head, Special Counsel Robert Mueller has officially reported Stone’s latest infraction to the judge.

Stone posted this photo on Instagram stories, where posts automatically disappear after 24 hours, presumably hoping that the ephemeral nature of the post would prevent its detection by the prosecutors.

With Judge Jackson already asking Stone’s defense attorneys why they didn’t notify her of the imminent publication of a new book by their client when she initially imposed her order for Stone to cease public comments on his case, she will now have to decide whether the only way to prevent Stone from violating her admonition to refrain from commenting publicly about the Special Counsel’s investigation into Stone’s actions or the pending criminal case against him or any of the participants in the matter will be to send him to prison until his trial date.
